My brother had a son by a lady, that died 4years ago, her sister has guardenship, because the mother had the baby in prison( brother didn't know about the baby then). The mother got out jail got herself together, and the kid moved back in with the mother. Mother never got guardenship back from sister, mother died four years ago.The sister took the boy from step father that was married to the mom( not my brother) Since then the child was taken from the aunt because of abuse and drugs, I had temporary guardianship, until the aunt finished her drug program, then the child was placed back with the aunt.The aunt isn't able to care for the child, and I witnessed where the aunt is very verbally abusive to the child, the child is afraid of the aunt ,want can I do to get custody and adopt the child?

I would contact the Children's Services agency in your area. Are you willing to adopt the child? Is your brother willing to take custody? If you can prove the abuse, you shouldn't have too much trouble getting temp custody until you can make it permanent in court.

Go back to court with the evidence to substantiate what you've said here. File a new motion for custody.

Contact child protective services ASAP. You can find them in the phone book under the government pages and it is under Health and Family services. When you call there you will be able to be connected to child protective services. Good Luck!!
