    Bank won't refund my money
    I live in a small town and have banked here over 25 years. I sent $400 to an immigration lawyer who's helping my wife. The $400 wasn't for a bill and she hasn't cashed it in 10 weeks and says that she don't want my money and for me to just stop payment. (she's moved from Iowa to New York and has a new law firm there) I told my bank this and after a few days the bank decided that I can't have my money back. It looks like theft of my money by the bank to me. What would you do?

    If the check was never cashed, then the money is not taken out of your account, to give back.

    So was the check cashed or not.

    You said check was never cashed ? So they can't give money back, for a check that was not cashed. The money stays in your account till it is cashed.

    If it was cashed, then the attorney owes you the money, not the back.

    I'm sorry... I didn't make my question clear enough... I bought a prepaid money order for $400... so the bank has my money and the lawyer has moved from Iowa to New York... sorry.

    Banks sell bank checks or cashier's checks. Why can't she send it back to you? It's cashable for a certain amount of time and can't have a stop payment put on it during that time, perhaps 90 days to 6 months, but you need to go into your bank and find out the process for after it expires. The bank isn't trying to take your money.
