View Full Version : OPT after graduation and not a RESIDENT - do I get SS and Medicare taxes back

Hi,

My employer seems to think that while I'm working for him under OPT that they need to withhold my Social Security and Medicare taxes. I thought this was only true if I qualified as a non-resident (which I no longer do). How does this come out?

While on OPT, you are EXEMPT from Social Security and Medicare taxes. You should request a refund from the employer, then file Form 843 when the employer refuses.
