As I stated in my thread below I have been sued by Midland Credit Management for an old credit Card Debt. I feel the sol has expired. I called the original creditor (Emerge) they were able to tell me when the acct. was opened 01/2001 but said they could not tell me when last payment was made, I would have to contact Midland for that. They said that Midland bought the acct. in 9/05. I filed the answer with the court that I deny the debt and all allegations therof. They told me when I took it to the Court that I would hear of a court date in 4 to 6 weeks. Do I still need to file a "Intend to Defend". I also want to ask for discovery information. (documentation of acct, payment history etc. ) will I need to fill this through the court or can I send it straight to the attorney handling the case?

Yes you do need to file Notice of Intend to Defend, or they will get a judgment by default.
