The condo unit above me has been a rental for several years now. The current renters seem to have many issues with living in a proximity of each other. They don't seem to follow the rules, complain about everything everyone does, but mostly me. They think I am the one to give them grief. When in fact, the rules of the association are being followed.

For the past 3 months, the nighttime noise ordinace is continually being violated by the unit upstairs. They run their laundry any where from 9:30 until 11:30 PM usually on Sunday evenings and now it's even during the week. When the police are called, they always seem to be on the defense and say things that I do to bother them. They don't tell that they are doing things to cause the friction. The police have said that it is an association issue and they must deal with these issues. The HOA is not responding to any emails or phone calls I send.

What are my rights as an owner for 17 years? What can I do to stop the harassment from the renters? What can I do to have the HOA make the owner accountable for his renters actions? Any suggestions at this time would be appreciated. Thanks

Have you tried actually talking with the homeowner? My HOA has meetings... maybe going to one of these meetings to bring the issue up would be helpful. Also there are specific people on the board of the HOA who you can contact. Keep a log of the infractions that are bothersome, against rules. This will help back up your case with both the HOA and the owner. I know the owners of some of our condo's don't like to hear complaints about the tenants and are usually quick to take action. Remember, YOUR paying the HOA, not the renters. You have a vested interest in this community while they may be here today gone tomorrow. Cathy

I have to ask if you have tried talking to the tenants. I have to admit, doing laundry late at night is different to me than if they were having parties, and may not actually be against the noise ordinances. I worked a job for a while where I didn't get home until 10 at night, which meant that the laundry was being done at that time and I'd be going to bed with the dryer going. If that's your only complaint against them, I have to wonder if you are being too picky, and whether a better solution might not be taking measures to dampen the sound transfer between the units.

Why do the renters think that you cause them problems? Have you tried talking to them. If you could tell what your neighbors are accusing you of and also which state you are in, then members of the board can try to help you according to the laws of your state.
