View Full Version : Is there another way to proceed with adoption ?

I got custody of my daughter in 2010 and her mother went against the court order once she finally was able to visitation. I called my lawer and took his advice and didn't let her see my daughter again, fearing her safety was in danger. Well, she don't pay childsupport, she don't call or come. My daughter wants my wife to adopt her but I really don't the LONG drawn out process of dealing with her mother. Is there another legal way that my wife can adopt my daughter?

It would depend, of course, on what state or country this is in, but as far as I know there is no place where you can legally achieve a step-parent adoption without at least giving notice to the other biological parent (in your case, the mother).

Once you do that, it is to a certain extent up to her mother as to whether it will be a long, drawn out process or not.

An adoption is a legal process that has to be approved by a court. The court will require that the parent who's rights are being terminated be informed of the action.

Whether they will grant the adoption over that parent's objections will depend on several factors. So the only way to avoid this is to make sure the parent will agree. I would discuss this with your attorney.

No there is no other way than hiring an attorney and filing, the bio mother will be notified, and a hearing will take place.
