View Full Version : Reinstate or Serve time for a VOP of leaving country w/o permission

My exhusband has 15 years of probation. He had a VOP in 2005 for violating community control; and he was arrested this week on a VOP for leaving the country without permission.  He has 6 years left of probation.. how much time will he have to serve, or will the judge reinstate his probation?

Was he arrested on the 2005 charge ?  If so, the day he violated,  his probation time stops.  So if there was a warrant issued in 2005 and he was just arrested on it?
 
If this is not the case please clarify your question,  was there a second violation, and if so when did it happen.

It doesn't matter how long he has left.  Unlike parole, he doesn't have a "release" date..  So, depending on how badly they want to screw him, they could make him do whatever the original underlying sentence was.  OR, they could reinstate him...
