A corporation general manager was personally delevered a summons and signed the acknowledgement of receipt in behalf of the corporation; he also signed three other acknowledgement of receipts for 3 of its employees who work directly underneath him at the same job site. On the summons directed to the corp. the summons was marked as an individual and under 410. This is a Calif. Case. A few days later the court issued a show cause oder to plaintiff stating failure to serve all 4 defendants. If I discover the defects with the summonses, can I send out 4 more summonses before the copurt date or do I need the permission of the court?

THANK YOU ANYONE

I own and operate a process service company in NY, and I don't know what you are asking.

Why wasn't the service on the "general manager" both individually and on behalf of the corporation and the other employees deemed good service?

What does the Show Cause Order address?

Are you the Plaintiff, the Defendant is arguing bad service and you are questioning whether to re-serve the paperwork on all 4 individuals?

In NY there would be FIVE services - the Corporation (if it's a party), the general manager and the three other employees.

What do you mean by "if [I] discover the defects... "
