View Full Version : Bone in triple steak from taco bell

I bought a triple steak from taco bell an when I was eating it bite ibto something hard that hurt my tooth so I immediately spit it out to find it was a bone an a sharp one at that, I still have the receipt that says the date an time an I took a picture of the bone that says the date an time, can I sue or do anything about this?

You could only sue if you had to have dental assistance to fix a broken tooth. But in your case you said the bone only hurt your tooth so I guess it was not broken. You can go back to the store and show them the bone and your receipt and see if the manager will offer you any free meals. At this point there is nothing to sue over. Pieces of bone happen all the time in any ground meat product and are essentially considered nuisance lawsuits and are handled accordingly. Now if the bone had pierced your gums or cut your lip and you had to have medical attention then you could have your bills paid by taco bell for the medical attention.

You just pointed out one of the prime reasons I don't eat out anymore.

Also since you did not even make a claim that day, but waited to even call and say anything it will lessen any possible claim.

I agree, since there was no normal harm, no tooth or mouth injury, there is really no claim to be made.

While I do believe you, knowing how Taco Bell does their meat, it is hard to believe a bone made it though the process.

Why are you jumping to the thought of suing someone? Did you suffer any physical or monetary damages due to this? Did it occur in the restaurant?

A lawsuit is primarily a way for a person to recover damages they suffer. Since all you apparently suffer was some momentary pain from biting into something hard unexpectedly, you have no grounds for a law suit. Besides which you have no real proof that it happened.

I would, however, take twinkiedooter's suggestion and go back to the store with your evidence. Should be good for at least a free meal.
