Can I get temporary custody of my grandaughter , cps took my kids just about 40 yrs ago, but 10 yrs ago I adopted her brother, so what's the problem.

What has CPS told you about being able to adopt the child? They may feel that having one child is enough or they may require you to go through the process all over again to qualify. Who knows where their mindset is.

CPS often does not have to have a reason, many times it is just the opinion of the case worker.

But the issues from 40 years ago can come back to hurt you, in some case workers mind, And they may look closely at the current child and how you care for them.

I take d.. Good care of this child, the little girl has been in my care since she was three months old. I dressed her like a little princess.

Obviously they don't realize that I have went to family Law and got legal custody of my grandson.

First, ANY question on law needs to include your general locale as laws vary by area.

Second, you said you adopted the grandson, then said you got legal custody. These are different things so which is it?

You said you have been taking care of the little girl since she was 3 months. How old is she now and what legal rights do you have now for taking care of her? What have you done to apply for legal custody? You obviously when through it with your grandson, so you should know the process.

Oh and by the way, saying you "dress her like a little princess" doesn't necessarily mean you are taking good care of her.

Excuse me ,I am a grandmother and I do take care of her mentally and physically .cps gave me custody of my grandson 10 years ago .now what I need to know is , why couldn't they find any records , I have legal documentation on that adoption so if I got him to cps why are they making a big deal about this now ,they are saying because of cps taking my kids,I wouldn't qualify for this child.

First, I asked you several questions, you hardly answered any. You still use custody and adoption interchangeably and they are not.

You haven't told us your general locale or what you have done to get custody. You didn't answer how old the child is or how long she has been with you and what legal right you have to care for her. How do you expect us to help you, if you don't provide us the info we need to do so.

The only thing you did answer was why CPS is saying no, because of the earlier removal of your children. If CPS says they don't have the docs on the custody/adoption of your grandson, but you say you do, then have you shown them the docs? Have you petitioned in Family Court for custody? Where are the bio parents in all this?

It's difficult to understand what you are asking when you don't give the details that are requested and have attitude. No one knows why CPS decided how/what they decided EXCEPT for CPS. We can only guess or venture a thought or two.

Dressing someone like a little princess does NOT make that person a good or responsible caregiver.

Why can't CPS find the records? Presumably CPS knows. Ask them. You also have to have an Attorney for the adoption process. Ask that person.

This child is two yrs old. I live in Spring Tx . And to answer your many other questions,I did get a lawer. Cps did a back ground check on me in 2002 to see was every thing OK with me to take custody.

I think this stems from us asking for more info and you not giving it. Your answers have had a belligerent tone to them

As it stands now, is CPS blocking your request? Have you applied to Family Court for custody?

I am sorry if I came off, any thing other than respecting, no I haven't, applied . Cps took custody so the kids could be with a relative, so they are with there aunts, but not with me.

CPS took BOTH children, including the grandson you had custody of?

If you haven't gone to court to petition for custody, what are you waiting for? The longer you take the harder it will be.

But frankly, I think you aren't telling us everything. If CPS removed the children from you, I suspect it wasn't over something that happened 40 years ago.

I don't want to adopt her, I just want temporary placement until the mom is finish with all of her parenting classes and getting herself a job, now that may take a year until that time I want to be responsible for her well being.

We DO understand what you are saying. You want temporary custody of your granddaughter. We have understood that from the beginning. We also DO know the law and the law gives courts wide latitude in cases like these. But you HAVE to go through the courts. CPS apparently made their decision. The only avenue of appeal would be to go to the courts. We have told you this.

You came here asking for help and we have tried to help you. But to do so we need answers to our questions so we can give the best and most accurate advice. Do you think a lawyer or court is not going to ask the same questions we have asked? But you have been very uncooperative in providing the information we have asked for. You have been rather ungrateful for us giving of our time and expertise to try and help you. Then you insult us to boot.

I'm going to give you one more chance. Apologize for your tirade and give us the info we've asked for and we will continue to try to help. Otherwise, I'll just close this thread.

I'll pose the same question again - how would anyone here know why CPS can't find any records - ?

So here's my legal opinion - records are destroyed after 10 years or when the child(ren) reaches the age of majority. That happens within 40 years.

Or you treated the CPS worker like you've treated us here and they don't want to help you.

There's a lot of that going around.

Ok, its closed, but like the others here, I think its clear why you lost the children recently and in the past. You have been belligerent, uncooperative, rude and abusive in this thread. Its not a stretch to guess that you act similarly in real life.
