View Full Version : My boyfriend was on probation for a crime committed over a year ago...

His insanity plea was taken and he was only given probation. They recently found evidence of a second crime (same as the first) within a week of the original crime that he also has no memory of. It was proven on lie detector tests that he honestly could not remember it and he was diagnosed with PTSD from a psychiatrist. He has not had any probation violations and has been on time with all appointments and has paid all his fines on time for over a year now. Do you think he will do jail time or is it possible the insanity plea of the first crime will be taken in to count as it was only a week after the first that he committed the other? This all happened over a year ago but he was only just arrested about a week and a half ago. This is in Kentucky.

This should not be a probation issue, but will have to be a new charge issue, he will be charged again, and he will have to plead again and have another court case.

*** only issues I have on this is
1. that insanity has nothing to do with remembering the crime, but if you knew right and wrong at the time of the crime.
2 ** polygraph is not normally reconised in criminal trial since it is not completely 100 percent reliable.

To have received probation he would have had to accept a plea deal at trial resulting in a guilty plea of some sort.

So he starts the trial process all over again
