View Full Version : How do I evict my roommate?

My roommate and I have both signed the lease agreement through the apartment complex she has been late on rent already and has stopped paying utility bills that I have had to pay for she has not stayed at the apartment in almost a month and I believe is planning on moving out she owes me money for utilities and has now taken some of my belongings and is claiming that things that are mine and have been for years are hers she had the sheriff let her back into the apartment and is still staying here using utilities and I'm afraid that she's going to take more of my things I want her out and need to know what I can do to get her out ASAP she already gave me a verbal 60 day notice about 2 months ago so I changed the locks because she has been taking my belongings I want to go about this the right way so that I have grounds for her removal please help!!

You are her are both renting and are both on the lease, you can not just lock her out, you will have to talk to the landlord. You can sue her in court for what she owes you

What State? If you locked her out - and you apparently did - she owed you no money after the lock out date and also has grounds against you to sue for illegal eviction.

You will be very lucky if she doesn't sue you for illegal eviction. YOU have no right to evict her since you are both on the lease. If you could have proven she was stealing from you you should have reported it to the police.
You've been going about this the wrong way up until now. You can lock up your belongings but not lock her out. At this point there is nothing YOU can do to evict her. You have to get the landlord to evict her and that could mean evicting you both.
My advice is to talk to the landlord. I would also not advise that you sue her for what she owes you. Because if she countersues for illegal eviction you will lose, I would just work with the landlord to get her out and cut my losses.

"verbal 60 day notice about 2 months ago " notice of what that she was leaving or she was going to evict you, I 'm confused. The moment you changed the locks your ice got real thin.
