View Full Version : Terminate Restraining Order?

I wrote out a long post explaining my situation, but when I went to submit it, I came back as not logged in and my post disappeared. I'll see if I can recreate it if there is anyone kind enough to want to try helping me.

Basically I am seeking advice on how to terminate a restraining order. I am at a loss on how to word the motion to terminate and need help. Thank you.

When I type something long I copy it so that if I lose it I can paste it and try submitting it again.

Did you get the temporary restraining order and later go for the permanent one? Did you file charges as well?

Did you get a form for modifying/terminating the order from the same place you got the restraining order?

You know depending on the situation even if you drop the order the state can still pursue it.
They can also charge you with making a false report if you try and say it never happened.
Also, the court doesn't look too well at it if you have more problems and try going again for another order if you be terminating orders.
Just letting you know some things to take into consideration.

And remember to be very very honest if you write something way too long most experts won't read it, or not all of it, If you sum things up it is a lot easier.

Okay, let me see if I can clear this up. My original post explained everything, but since I lost it (thank you both for the advice) let's see if I can respond.

I am the person whom the restraining order is against. The persons who sought the restraining order did so to harass me, and they are still harassing me. It is a very long story. This all stemmed from a dispute on an internet forum where I offered to help someone. That someone lives in my community and wants to harm my reputation as well as damage my business.

This past Summer they then filed to hold me in contempt of the order because I answered third party questions pertaining to the order itself which were posted online by operatives and friends of the persons who got the restraining order against me in the first place.

Does that make sense?

The court appointed an attorney to represent me on the contempt issue, but that lawyer says there is a massive amount of good cause for me to not only have the contempt charge thrown out, but to both file a motion to terminate their restraining order and get a restraining order against them.

Where I am having a difficulty is how to word the motion to terminate and the termination order I will have to file with the court. I cannot afford to pay the lawyer to do this for me.
