I live in Texas and am the father of two children. My son is 12 and my daughter is 10. About 3 months ago I found out that my wife was having an affair. I tried to get counseling, tried to talk to her, and several other attempts to mend our marriage. I finally moved out. I moved out to try to figure out how to process everything. She continued to see him so I finally decided to file for divorce. She was aware of me doing it, just not how I did it. I sited adultery, that I wanted the kids, that I wanted a larger share of the assets, etc. Both of my children are willing to and have signed a document that states that they want to live with me. What chance do I have in getting custody of them? Will I have to spend thousands that I do not have attempting to do so?

Depends on how much the wife fights you. Your children are too young to have their preferences given much weight.

Adultery is grounds for divorce in Texas, but you may need to prove it.

If your wife retains an attorney, then you will need to do so as well.
