What is the harshest possible punishment for possession of a controlled substance: cocaine, more than 1 gram and less than 4 grams? This guy has been indicted on the charge but not yet convicted. I believe he was convicted of possession once before, less than 10 years more than 5 years ago, and completed probation.

If it was that easy, we could fire judges and just look it up in a book. In addition to the few factors you shared with us, there are dozens more that we don't know about. Plus, we don't know if the judge is a hanging judge or a really nice guy, although I don't think ANY judge in Texas is very nice...
So, there's just no way to tell.

Thanks excon. Out here in west Texas we have to worry more about the DA than the Judge; usually our judges (in quite backwards fashion) follow the prosecutor's lead. I appreciate your input and will pass along that my friend is now living a mystery. We'll just have to wait and see. Thanks again!
