My stepson was involved in a traffic accident. He was driving through an intersection when another driver ran a red light an hit him an his 2 passengers. My son does not have a valid drivers license, the car was registered to another party and they had no insurance on the vehicle. The other party was clearly at fault however I'm sure he is in some kind of trouble. This happened in wi.

If he didn't get a ticket at the scene, he's NOT in trouble. Oh, maybe with YOU, he is, but not the cops.

Plus, the other driver MUST pay to repair the car your son was driving. If a driver is to blame, running into a car driven by an UN-insured or UN-licensed driver does NOT get him off the hook.

Whether he has a license or not does not change liability/responsibility for the accident. You would have to pursue the other driver personally for the damages. Did the owner of the vehicle your stepson was driving have uninsured motorist coverage?

Were there injuries?

I don't know how recent this accident was but it is possible that the unlicensed driver charge will be brought following the approval and filing of the Police Accident Report.
