He would have to first prove he is the father, then prove you are an unfit mother.

Well, is he listed on the birth certificate as father, if so, he has as much legal right to take the child as the mother does, until there is a custody order in court.

What kind of things? It would have to be pretty serious in order to prove you unfit.

He has as much right to the child as you have.
If you are endangering - or have endangered - the child OR if there is REASON to believe you could endanger the child he certainly can try for custody. BUT - if the child is not in danger and has not been endangered he will not win.
He certainly will be entitled to visitation and you will be entitled to support.
