View Full Version : Can I sue My father for abandenment and no support?

My Father left mother and 3 children 40 years ago without paying a dime of support. Mother did file for child support, but no inforcement since he mved to arizonia and could not be located.Now that my mother has passed, the family could have used the money for funeral expences, college. Besides him being a jerk and not wanting to communicate with us sons, he needs to know what it is like to live with very few funds. He has inherited funds from his father and refuses to pay up.

Most likely not, I would guess ( but you can check with local attorney) that the statue of limitation to collect any moneys have long ago passed.
I am sorry but your mother needed to have done that yeas ago.

Papers were filed, but he moved out of state. I just now located him. On another note, wonder who gets his SS when he passes.

Fr. Chuck is right it's a shame that no one was able to locate him but that is something your mother would have had to pursue a long time ago. As for his SS that (in cases I've known) stops when the person dies unless they have minor children then there would be a death benefit for them but being that there were three kids 40 years ago I wouldn't imagine there to be any minors left.

I don't really know but.. my mom signed her rights away and I was wondering the same thing
Because she is refusing to take care of me..
