View Full Version : What are legal consequences for deformation of character?

My ex and his mom have called all of my daugther's doctors telling them I am an unfit mother, bipolar, crazy, lazy, and they have gone as far as filing a DSS report on me (which I came out to be a fit parent and his mom received a finding of neglect on her).

I have written proof (in a doctors note and in the DSS report itself showing that they were saying things that were not true). This has been going on for 2 years now and it is getting worse. I have had enough. We have 2 children together so I can't kick him out of my life completely (although I wish I could). What legal resources do I have to make this stop and maybe get some restitution from this?

You should be able to get a restraining order for harassment against her. It sounds like you must have enough documentation to prove harassment.

To obtain a restraining order, a person must prove, by a preponderance of the evidence, that the abuser has caused or threatened to cause physical harm, or has placed the victim in fear of imminent serious physical harm. Violation of the order is a criminal offense, punishable by a fine and imprisonment.

In your state it has to be physical harm. I don't know if fear of having your kids removed could fall under that but it may be worth a try.

As far as defamation goes that's a civil pursuit. That involves damages etc. so you will need all the proof you can find plus any added expenses that have been wrought upon you.
