Trying to find out for a young girl who just turned 18 years old and lives with her father. She has a baby 6 month old and has went to court with the father who in college out of state and has tested positive for drugs and has to pay only $150. They have not sign the jugement they were suppose to and she has no papers. Unable to get in touch with lawyer who she paid a few thousands dollars. The fathers wants the child, for the weekend but has not sign any papers. She shouldn't have to hand the child over till she has judgement papers in her hand and sign papers

Child support - if that is what the $150 is - and visitation are unrelated issues.

I don't understand what Judgment they were supposed to sign.

Would I let my 6 month old child spend the weekend with the father who has tested positive for drugs if there were no Court order in place -

No, I would not. But that's just me.

Ok, child support has nothing to do with visitation, they are separate issues.

Is there a custody order in place ? If no, is the father on the birth certificate ? The reason I ask, if he is on the birth certificate and you have not gotten a child custody order in place, actually he has as much right as the mother legally to have custody of the child.

If there is a custody order in place and visitation order in place the mother is suppose to obey it.
The drug usage is one thing, if she wants she can try to make his visits supervised, but will have to go back to court for it.
