View Full Version : My dog goes to the neighbor's backyard

We have lived in the same house for 14 years and the fences were there when we moved in. There were all new houses and the neighbors put up their fences and we didn't have to put a fence because they were there other than the gates on both sides, that are ours and we put up.
The house to our right is owned by a "corporation" that is always renting it out and all that we meet are the people that rent the house fro them. Several years ago a couple of panels from the fence were falling down, and after many letters to the HOA and to the owners (corporation), they finally "fixed" it. We also purchased a couple of 2x4 and put them there to avoid it falling over. The fence was not completely fixed, but "patched".
The problem now is that the fence is completely gone in portions of 3-4 feet and 2-3 feet along the side, and our dog goes over and "visits" their backyard and poops on their side.
They have already told my daughter for her to go and pickup the poops from our dog.
I don't think that we should be picking it up, since if there was a fence, he wouldn't be visiting them.
Can anyone give me some advise on how to handle this? We don't have the money to fix the fence, and don't think that it is our responsibility to fix it since its theirs, but I might be wrong.
Thanks.

Since it is not your fence I agree that you should not repair it. I think you should go back to the homeowner association again with a written complaint form. You could also go to your county building dept and see if they can issue a building violation.

As for the poop I disagree with your stance. It is from your dog so you should pick it up. If there where no fence you would have to watch your dog.

If they decide to take the whole fench down instead of repairing it you will have to be sure your dog stays in your yard.

Can you put up one of those runner things that is like a clothesline?

You are responsible for your dog, if there were no fences at all, you are still responsible to keep your dog in your yard, If he "goes" somewhere besides your yard you are responsible to clean it up.

The repair of he fense is a separate issue for the HOA to look into

At least in my state you are braking the law by not having the dog on a leash. It is not the neighbor's responsibility to keep your dog out of their yard, it is yours fence or no fence. I'm not as nice as your neighbor... I would only say something a few times then I'd call animal control and let them give you a nice fine.

It is your responsibility to control you dog's actions be it roaming, entering someone else's property, and/or pooping anywhere that is not sanctioned by law. You need to either train your dogs not to go and poop there, put down some chemicals that will deter thm from entering that area, or put up sinder blocks, wood panel, or something... because at the end of the day it is "YOUR PROBLEM". Heavens forbid, they should bit someone after their 'poop'... OUCH, hope you have deep pockets. Hope this helped. Good luck.
