If you knowingly committed fraud, yes, you could be criminally charged. It doesn't happen often but it does happen.
If NY wanted to pursue you I don't know how you would explain that such an omission is NOT fraud.
On the other hand "usually" if you file and pay any taxes/fees/penalties they let you slide. Of course, this will trigger a close scrutiny of your past and future returns.
If you have filed and were due refunds on each return, no way.
If you owed a LOT of money which you COULD have paid, but now cannot, maybe, but NOT likely.
