    Is it legal in the State of Virginia to evict a pregnant person from an apartment for being 13 days late on the rent?

    Being pregnant does not give a tenant any more rights that a tenant who is not pregnant.

    VA laws allow the landlord to evict if rent is even 1 day late. The landlord does need to deliver a "pay or quit" letter before he/she proceeds to court to file the necessary papers.

    While I don't dispute what LILL said, I think a judge is going to be more sympathetic in this case (also depending on how far along she is and what her previous payment history has been). I think the judge will still order the eviction, but may give her more time to find someplace else to live.

    It depends is she 4 months or 9 months, was there trouble with the pregnancy, and why is she late.

    But they will get evicted, the judge may allow a little extra time but they will be evicted.
