I want to give my step son my last name. His father will not contest. What do I do?

First, this is a legal question so its been moved to the appropriate forum. Second, are you adopting your step son or do you just want to change his legal name? Third, ANY question of law needs to include your general locale as laws vary.

Generally you must prove in front of the judge that it is in the best interest of the child and it will not affect the child's relationship with the father,and it will not affect his /father's/feelings.;)
