There is really no hard and fast definition. I think the courts will look at whether the parent is a danger to the child.
Most of the decisions I selected have now gone to appeal but, you can get a strong opinion and legal idea of just what justices has cited as the courts responsibility toward and determining what the parental rights are and what the parental responsibly are. Do give more attention to the last court decision.

Luna, do you have any links to the same type of info for WI?
I'd like to know if the child being an age of 13 has the choice of seeing the "unfit parent". Does age constitute visitation over the enormous evidence that this parent is unfit?

It's best to start your OWN thread... You'll get much better response that way.. I know, you probably didn't know that.
At 13, a judge will LISTEN to a child, but he will MAKE the determination based upon the child's welfare - NOT the child's wishes.
If the other parent is "unfit", maybe supervised visits would be allowed. What I'm saying, is the abuse/neglect is going to have to be pretty bad before a judge terminates a parents rights.
