    Custody Of My Niece
    Hi.
    My question is how do I get custody of my niece or help her in some way with my brother still being able to see her? Im 21 with a son of my own, I live with my husband and his parents. My brother has a daughter 10 days younger than my son and he went through a whole bunch of crap with the baby's mother. She lied and lied and that put him in jail, and now he's out and allowing him to see his daughter, but now that he has a great job she stopped working, allways asks for money and spends it not on the baby and then I allways have to give my brother diapers, wipes, food for his baby. His baby's mama is neglecting her, she's allways dirty, I allways have to give diapers and wipes, and while the baby mama is sitting at Cumbies my niece is sleeping in the van while she goes about her life as if she doesn't have a kid. And my brother can't take his daughter because he lives with our parents and they won't allow her to live there, it's a mirical that he's living there. Please help!

    Well if your parents won't allow your niece to live in their home then there's really nothing your brother can do until he gets a place of his own. Does he have a visitation order? In writing, from the court? If not, he should get one. He can also ask for joint legal custody even if she doesn't reside with him. Do your parents at least allow her to visit with him at their home? The extent to which your brother can provide lodging and other necessities for your niece will determine how much visitation he'll get and whether he may have a chance at getting joint custody.
