Nobody goes to jail for adultery anymore.
You get a divorce and move on.
My husband is having an affair for years now and I know the woman is there any alw in Folrida about the adultery?how heavy is the punishment ,if that is proven how long can they be in jail?
You know, I'm not here to argue with you... I'm not here to say if the law is right or wrong. I'm not here to say if adultery is right or wrong. I'm not here to say if laws should or should not be based on the 10 commandments... you asked a question, I gave you the answer.
Nobody is prosecuted for committing adultery.
No one is approving ANYTHING.
Church laws are enforced by the CHURCH, not the STATE.
You want him punished for breaking the commandment, then talk to your priest or pastor.
The secular law isn't going to send them to jail for you.
You want to punish them? Get a GOOD lawyer, get a DIVORCE, and get as much alimony as you possibly can.
And THEN---to put a religious spin on it--the best revenge is to be happy WITHOUT him. Forgive him (AFTER the divorce, of course) and move on and let your God mete out judgment and punishment, and you just live the best life you can with grace and forgiveness.
"2012 Florida Statutes
Chapter 798
ADULTERY; COHABITATION
798.01 Living in open adultery.—Whoever lives in an open state of adultery shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. Where either of the parties living in an open state of adultery is married, both parties so living shall be deemed to be guilty of the offense provided for in this section."
"775.082 Penalties; applicability of sentencing structures; mandatory minimum sentences for certain reoffenders previously released from prison.—
...
(4) A person who has been convicted of a designated misdemeanor may be sentenced as follows:
...
(b) For a misdemeanor of the second degree, by a definite term of imprisonment not exceeding 60 days."
But, as the others have told you, this is not going to be enforced.
No one is going to enforce an adultry law, It happens every day, most likely even divorce court will not care why you want a divorce and the reason will not even help in property settlement.
He will not go to jail, she will not go to jail, nothing will happen to them.
I did not think you were serious with the question, but after a few posts I guess you are. I can only assume you come perhaps from another culture and are not native to the US and have not lived here your entire life.
Cheating happens all the time, about 1/3 or so of all marrages have an affair at some point and 1/2 of all marriage ( first time) end in divorce.
To my knowledge all of the "bedroom" laws, even on the books, are not enforceable because of other Supreme Court rulings over the years.
If you want a divorce , divorce and move on, there will be no adultry arrests.
This is the Family Law forum. You asked a question about the law. Specifically about punishment for adultery. That question was answered. While many places still have laws against adultery on the books, they are never prosecuted. No one goes to jail for adultery in this country.
And the 7th commandment is not a civil law. It has not been abolished, only, largely ignored.
Please don't mistake the answer to your question about the law to be condoning or supporting adultery. You asked a question, it was answered. As someone else said, the punishment is to file for divorce and take him for as much as you can.
And on a law board, Even God's law got an appeal, with Jesus. I remember Jesus telling the crowd that was going to stone the women for adultry, that her sins were forgiven and go and sin no more.
So Jesus, the final defense attorney for all of us in God's law, has found and given forgiveness over the earthly punishment.
