Can I press charges against him for having realtionships with a minor , the ony sex we had is phone sex
Why would you want to charge him if he's your boyfriend? It depends where you live, and phone sex?. probably not.
You need to go with your parents IMMEDIATELY to the police and report this. They will tell you how to proceed.
Well first I will say that she calls him a boyfriend, so perhaps she is planning on trying to use the threat of jail against him,
Or something happened to make her mad at him.
He is a jerk and a pediphile of course but again I don't even want them railroaded by a teen either.
Just stop talking to him,
I'm with strawberrylover here, why would you want to press charges against your boyfriend? Seems awkward.
Take ScottGem's advice and tell your parents. They'll know what to do.
slapshot_oi finds this helpful : Balancer - and this is a legitimate question. The fact that she's younger than 18 doesn't make her automatically innocent.
Enigma1999 finds this helpful : Balancer - I too believe that this is a legit question.
Im going to address this. Since only part of this seems to be being looked at. This is the law board. So the law must be followed as best as possible with what's available.
Having said that. The question may be legitimate but the rest of the answer is NOT!!
Its is illegal. Period. If you don't think so then show it. But the way the law reads its illegal and the OP can't consent. She is too young. So by stating probably not. That's just not true. The fact that she is under the age of 18 or even 16 makes her an innocent in the eyes of the law.
This is just the list of age of consent for sexual activity, meaning you have to be touching the person. Phone sex isn't mentioned.
The only thing I can find is phone sex with a minor is illegal in Cali. That's it.
Slapshot I know your smarter then this.
Here is a list of laws that apply on federal levels as well as state levels.
Gainesville, Florida Computer Crime Defense Lawyer :: Transmission of Material Harmful to a Minor :: Fort Myers, FL Criminal Defense Attorney
2008 Federal Sentencing Guidelines Manual - 2g2.2
2009 Federal Sentencing Guidelines Manual - 2G2.2. Trafficking in Material Involving the Sexual Exploitation of a Minor; Receiving, Transporting, Shipping, Soliciting, or Advertising Material Involving the Sexual Exploitation of a Minor; Possessing
:: Anti-Child Porn Organization ::
What he is doing is sexual exploitation of a minor. There the law has far reaching arms. Its like the difference from looking at someone lets say through and into a car window and looking at someone through and into a changing room. One is perfectly innocent and the other is not. But they both involve looking. I think you get my point here.
I'm going to step in here. I agree with CalifDad that a 24 yr old having ANY sort of sexual relationship with a 15 yr old is exploitative and there are laws that can be used to prosecute it.
While this may not have been started in the legal forums it is clearly a legal question and should have been treated as such. I believe the response that got the reddie deserved it because the assumption would be that if the OP was asking about pressing charges they were planning on severing the relationship.
No both sides have expressed their opinions here, so I will suppress any further argument on the issue of the first response and the legality of phone sex. In fact, until the OP returns and follows up. I think there is no further need for discussion. The only reason I'm not closing the thread is to give the OP an opportunity to follow-up.
