I have a fried that serve 16 months for 5 dwi's. He violated parole and did rehab. He violated parole for public lewdness, and public intox the second time. Will he do time??

I don't know where you get your information from but your wrong on all of this.

Some of these answers r correct and some r not. If you violate your parole in Ohio it all depends on what you porbation officer wants to do. He/She could or could not violate you depending on the violation and depending on if you caught a new case or if you have been charged. He/she could place a hold on you while your in jail waiting on a hearing so you can not bond out, or they could not put a hold on you and you can bond out. If violated you judge can only give you the max of 1/2 you probate time. So if you have a 5 year sentence then you can only do 2 1/2. Most do not give that whole amount. Now if you got out of prison before you whole sentence was up you will end up doing your whole time unless your still under the old law, then they can play with how much time you do.

I just found out that I have a techinacal violation for undeliverable mail. I thought I was off probation now for well over a year and a half. When in fact they issued a warrant 5 months before I was suppose to expire off. What does this mean. Can they make me serve the remaining 5 months is jail, or is it typically a 30 day violation and then finish 5 months of probation.
I am turning myself in in the morning: My attorney said we will then be herd by the judge the next day??

Yes, you could be sentenced to the remaining 5 months or you could be warned. I trust your Attorney knows your situation better than we do - listen to him/her.

My boyfriend went to jail 1 month ago and he is in there for violatioln of probation and assult with deadly weapon but he didn't use a weapon I just want to know how long he can get for this?

Want to tell us where? It varies. I suspect you will go to jail for the full sentence you would have received if you had not been placed on probation.

What type of time will my boyfriend have to serve if he missed his parole appt on may 3, in Houston, Texas (he actually signed in on May 3 to see his parole officer and she wasn't available so he left.) but still went to see his officer on May 30, then went back 3 times to see the supervisor and she wasn't available, and he also signed in, then his parole ended on June 30. They picked him up this morning on parole violation. Did 3 yrs on parole and never was violated, until now. He served 10 yrs in prison, and it hurts him to be back in jail because we have a 13 month old baby that he loves to death. He didn't want this to happen again. Somebody let me know some info. In MY view, they CAN'T violate his parole AFTER he's OFF parole. They only have one shot at him and that shot expired when his sentence did.

I'd hire me a damn good lawyer.

Its different in every state, like here in Oregon my husband violated parole by not registering his new address, and I guess he had a bench warrant for failure to sign up for community service from a previous conviction. He was facing sentencing still for another crime (long story) so a week before sentencing he gets the PV and while in jail for that he got sentenced for the other crime for 40 days that got reduced to 32 days and minus another week time served. Then at sentencing for the PV another week later he got a 4 month work release sentence which might just be as bad at county lock up because he has to pay additional fines of 3 grand on top of the restitution he owes of 9 grand! He was sentenced to 18 months 5 times but they all are congruent with each other thank god! The only thing I want to know is does he still have to do that community service now that he was sentenced to something else? And can he appeal work release or abscond work release and just get a jail sentence for the PV, could that mean he does the actual 18 months? He has until the 16th to decide. I want to ask a lawyer because the court appointed attorney did nothing. I can't afford anyone expensive to file an appeal but I need to know if he should even do that. He just doesn't want to do work release, he wants to take responsibility for his actions but wants to get a job, he just doesn't want more fees to pay..? Do I make sense?
