    Wrong Tax form filed by f-1 student. Filed 1040 instead of 1040NR.
    Hello,

    I am in a dilemma and I will really appreciate your help.

    I am a student/f-1 visa holder (non-resident alien). Last week I used an online website (File my taxes for FREE! with FreeTaxUSA) to file tax returns and realized that the website used Form 1040, and PA-40 - 2007 (for Pennsylvania Tax returns), instead of Form 1040NR and 8843. The e-filing website showed that my e-filed federal tax returns were approved by the IRS, and the Pennsylvania tax returns were approved as well.

    Since it seems that I used the wrong forms, what should I do to make the ammends? In the last two years I used Form 1040NR-EZ and form 8843, with the help of my college. This year I thought I'd try to do it on my own, and seems like I filled the wrong forms. The e-filing website says that I will receive the refunds in 10-15 days since I requested for direct deposit. Will I have to send back the money to the IRS or whoever? I really have no idea and do not know what I should do now, so any advice/suggestion will be greatly appreciated. I can't believe I made this mistake just last week.

    You need to file Form 1040X with a properly-prepared Form 1040NR-EZ and Form 8843 attached. Print the word "AMENDED" on the top of the first page of Form 1040NR-EZ.

    You will get the original refund as submitted.

    If it turns out that you OWE taxes, just mail a check with the Form 1040X. If you mail the Form 1040X with the 1040NR-EZ and 8843 BEFORE 15 April 2008, there will be NO penalties assessed.
