    What tax residency am I? FT home in KY, apartment for work in OH. Residency?
    For Federal and State tax filing, I would like help determining residency status. I own a home in KY with my wife where she lives full time with my kids. I started a job on 1/3/10 in OH where I rent an apartment and stay during the work week. I return to my KY home for weekends, some extended weeks, and vaction weeks and Holidays. What residency do I file for federal and for State? Also, would it be advantageous to file separately for either Federal or State? Thanks for any help.

    I believe that Ohio and Kentucky has a reciprocity agreement where the residents of either state who work in the other state have ONLY the home state taxes withheld and for which they are liable for ONLY the home state income tax. I suggest you ask your payroll department about that.

    If not, you will PAY taxes to Ohio and file as a NON-resident, then claim a tax credit on your Kentucky tax return for the Ohio taxes paid.
