    My husband gets his taxes taken due to back child support. This year we are married and filing together. Will they take everything from our taxes together towards his back child support?

    Yes, they will take your return as well. When you file jointly, then you assume all tax liabilities together. If I were you, I would file married filing separately. I found this out the hard way :(

    That is not quite right.

    You can still file jointly and get your share of the refund by filing as an Injured Spouse. The Form to claim this status is Form 8379.

    Filing separately is also an option.
