    Social/medicare tax refund for J-2 VISA
    Hi,
    I am a graduate student at Vanderbilt University and my wife come here and got job to work for about 5 years and have been taxed for social /medicare taxes which she will not have any opportunity to have the benefit because we will have to go back to Thailand for good. Can she get a refund taxes and how?

    Sorry, but if she was working under a work visa (L-1, H-1, H-1B), then she is NOT eligible for a refund of Social Security and Medicare taxes, even though she will not qualify for the benefits. It's NOT fair, but that is the way it is.

    If she was under an F-1 or F-2 visa, she should not have been paying these taxes and CAN apply for refunds for tax years 2004, 2005, 2006 and 2007. It is too late for 2002 and 2003. She needs to use Form 843 to request this refund. If you need professional help with his process, contact me at the email address beow.
