    NJ State late filing penalty?
    I’m an international student, live and work in NJ.
    I received W2 for 2009 and 2010 but failed to file my tax return.

    2009 W2: income was $1330
    2010 W2: income was $2156

    After calculating NJ state tax, I owe approximately $5 for 2009 and $16 for 2010.

    I know I will/may subject to late filing penalty. My question is: should I estimate the penalty on my NJ-1040 at this point? Or I should just mail the forms/payments first and wait for notification from State?

    Just mail your return and the payment. The state will send you a bill for the penalty/interest

    I'm still confused.

    The income on the two W-2 listed above were all I made in 2009 and 2010 respectively (no taxes withheld). Therefore, for 2009, my Gross Income was $1330, minus $1000 personal exemption, my Taxable Income was $330. Then my NJ state tax would be $5. Using the same method for 2010, my NJ state tax would be $16 for 2010.

    BUT on NJ1040 instruction, it says "If you were a NJ resident for the entire year and your Gross Income on Line28 is $10000 or less if filing status is single, you have no tax liability to New Jersey and no return must be filed.

    So do I owe any tax? Do I even need to file one? Please help me clarify. Thanks.

    As the instructions say: if you lived in NJ all year and have less than $10,000 income you do not need to file, and you do not owe any income tax. So - did you live in NJ for all of 2009 and 2010? If yes - you can stop worryiong about not having filed.
