    If I file separately from my husband, can I take the standard deduction if he itemize
    We separated in October,2009.my gross income is $9786. And his is $45000. If I file married separately,can I take the standard deduction since I have nothing to itemize if he decides to itemize?

    No - if you both file as MFS, then if one of you itemizes you must both itemize.
