    H4 Tax Navigation
    B]Background[/B]

    • I've been on H1B for 5 years.
    • Living in OH filling 1040A for Fed Taxes.
    • Got Married in Dec'08. Wife came to USA in Jan'09 on H4.
    • Wife worked Jan-Nov 2009 in India and paid tax there.


    From reading posts around here steps I need to take -

    1. File 1040EZ with "Married Filing Jointly"
    2. Get ITIN - Form W7 with notarized copy of wife's passport
    3. File foreign tax credit - Form 1116
    4. Mail the 3 forms above together.
    5. Apply for extention with state taxes until spouse ITIN is assigned.
    6. File for city taxes.


    Am I missing any steps ?

    1. Yes, you can file joint return as residents. You may have to file Form 1040.
    2. yes, attach W-7 with your tax return.
    3. File Form 1116 Foreign Tax Credit or Form 2555 Foreign Income Exclusion.
    4. Yes.
    5. Yes
    6. Yes
