    H1-B Employer did not pay FICA for 4 months
    Hi,
    My H-1B started from Oct 1, 2007 and my OPT expired on 01/12/2008. My employer did not deduct any Social Security/ Medicare taxes so far from any of my pay-stubs. My questions are:
    1. what are the consequences of not paying the above mentioned taxes for 4 months?(My employer is going to start deducting those taxes from February 08 onwards)
    2. Is there any way my employer can "now" pay the SS/Medicare taxes together for the period of 10/01/2007 to 01/01/2008?

    Please help! How do I handle this situation?

    First let's find out which country you are from. The US has totalization agreements with 21 countries. If you have been in the U.S. for less than 5 years you may owe the social security tax to your home country if it falls under one of the totalization agreements.

    If you need to pay it to the U.S. Than the employer will have to pay his matching portion and you will have to pay your portion.
