    F1 student in CPT.what tax to pay?
    Hi,

    I am an F1 student working in a paid CPT in NY state, I have been in NY since I started my graduate school here which was about Fall 2008... I wanted to know what Taxes apply to me...
    1)Do I need to pay the NY state and City tax? Is my employer supposed to take these taxes from my paycheck?
    2)And also I wanted to know if I will need to pay the NY state unemployment tax?
    3) If these taxes are taken... I will still need to file for a return because of the tax treaty right??
    4) Do I have an option to not pay these tax and ask my employer to not apply these taxes? In which case I donot have to apply for the tax return!

    On F1/OPT you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to FICA taxes but you must pay federal and state income taxes.

    On your OPT income you will get deduction based on tax treaty between the U.S. and your country.

    I understant that my employer is supposed to deduct the state and federal taxes from my paycheck each time but I want to know if my employer is also supposed to deduct the New York city tax and NY unemployment tax? And I am from India...
