Claim my parents as dependent for tax return
I am a green card holder. My parents from China stayed with us for more than six month in 2006. Can I claim them as dependents for the tax file of year 2006? If yes, what should I do?

    Thank you very much,

    Helen:

You MAY be able to claim them if you provided MORE than half of their total support for ALL of 2006 and they did not earned more than $6,600 in the U.S.

You will have to apply for ITINs for them, using Form W-7, which must be submitted with the tax return.

What is the procedure for claiming them as dependents? How can prove that they stayed with me for more than 180 days? I did not get any notary while they were in the US. But I can get their exit stamping on their passports. Is this enough? Or is there anything else that I need to do to claim them as dependents?

    Thanks in advance.

    Angel:

Sorry, you CANNOT claim your parents because they do NOT qualify as U.S. residents.
