Can I get my H1B processing fee back in tax return?
Hi I'm a foreign national working in H1B visa since July 2012. My wife is in H4 Visa.
Unlike most employers, my employer didn't pay the sum for visa processing. So, I paid the whole amount that was $3,325 including lawyers fee. Can I file for a tax return so that I can receive that money back?

What country did you move to to work? US or Canada ?

The home country does not matter.
The IRS considers all visa costs a personal expense which is NOT deductible on your tax return.

I was asking the OP WHAT country he moved to, US or Canada. Not his home country. How do you know Atlanta, if it does make a difference in Canada, or possibly the UK. You are only replying for US.
So I ask OP again what country did you move to ?

Yes, so it is, well, have found out you always have good answers. I still think if it could have been Canada he could have recouped part of the expense, if there had been any living expenses incurred while travelling along the way, that is.

He CAN claim moving expenses for himself and his family, but the employer normally covers those expenses.

When you say moving expense, what does it include? Do you mean including plane ticket?

Yes, it does include the plane ticket.
It also includes extra baggage fees, and mailing costs if you mailed personal effects, shipping costs for household goods and/or car, and hotel costs enroute, to include the FIRST night at your destination.

I am H1B visa and my wife is on H4B.
I applied for my wife's ITIN with tax returns. Her ITIN application was rejected. I have resubmitted application for my wife ITIN with copy of my tax returns. I am waiting for her ITIN card.
