    2006 form 8379
    I have a question about form 8379 injured spouse. Me and my current wife filed a joint return this tax year and want to use the form to recover funds from earned income credit from her kids so the IRS doesn't take our refund do to my child support arreages. Who files the injured spouse my wife did not work in 2006. Part two of the form could you give me a bief explanation of what I am suppose to do and I am going to e-file my return and send this form to the IRS after I e-file. How does the IRS give you your refund on form 8379 if they get this form after I e-file.

    You have to submit the Form 8379 WITH the efile. Submitting it after the fact does no good. If the tax software does not permit this, then usedifferent software or file the return on Paper.

    Your wife files the injured spouse form.
