    Small claims case, costs awarded, but remain unpaid
    Hi, I won a small claims case as the defendant. The judge awarded my costs but the claimant has not paid me. How do I start to enforce this? I haven't done anything about it as he made an appeal so asked for a stay, appeal was dismissed, think he has exhausted every avenue now and I want my money or it going down on his file as unpaid. He is able to pay by the way, it is a small amount. All info much appreciated.

    You would get a writ of execution and seize his assets: bank accounts, etc.

    Thanks for that, do I ring the court to get the forms to fill in? I've never done anything like this before.

    Yes, either call the clerk of court or look online.

    You might want to get a small claims handbook, if available from the clerk, because it's complocated. You will need to get the clerk issue the writ and find a process server to seize the property. Wage garnishment is also available in most states.
