    I need my money back!
    My ex-boyfriend has been living with me since August of last year. He said that we will split all the cost 50/50. Since then he lost his job and when he did get paid, he would only cover his bills, since they are under his name.

    I have put everything under my name since he didn't want to affect his credit.

    Right now he owes me over 8,000 in bills and says to sue him, since he could say that I did it out of the kindness of my heart. May you please help. He also won't move out, since he says that he has rights because his things are there.

    What are my rights??

    Laws vary from to state to state but in some places is is considered a resident and must be served eviction papers or a 30 day notice to vacate. Taking him to small claims probably won't get you all of your money because of limitations but its worth the try.

    You are right, its limited information. Your name alone is on the lease? Did he move in AFTER you moved in? Has he ever paid rent? Does he get mail there?

    The likelihood is that he has established residence sufficiently to require he be evicted. But the likelihood is that you will win an evicition fight AND win in small claims court. However, if he has no money, how are you going to collect?

    Yes, my name alone is on the lease. His credit was SUPPOSEDLY bad, and I didn't not want to risk not being accepted. He moved in with me. He has never paid any rent. I keep hearing next week, and lets says that I have run out of time. He has 5,000 on my credit card and I am the one making the payments. The only thing that he has are all of his possession in storage and a truck that he's paying for!

    Jslim, you got to get this guy out of your life before he drives you to the poorhouse. Cancel your card and take out a new one he does know about. Go to small claims court and seek a lien of his truck or a judgement.
