Insurance re-payments
Hi folks. I am in a quandry on the debt limitations in ontario.ca.
I received a cpp disabilty payment approval in2002. My insuarance carrier now wants rebursment from the monies. I last received a payment from the insurance carrier the 8-31-04. They claim I owe 4000 dollars. . I have been called and they claim I will be forwarded through their legal services. Do I owe this money that I don't have. Is there a law protecting me. Its been years since I have had contact from these folks. . I have never agreed on payment or admittance to the debt .
Any thoughts?

Are they stating WHY you owe them re-payment? Are they alledging that there was no disability?

I received a cpp backpayment from cpp pension dating till dec 2002. The insurance carrir was notified of this when I received the cheque in August of 2004. They stopped paying me,immediately. Not hearing from the insurance carrier from that dateofcontact may 19th 2004. Its now oct 2008 they contacted myself stating I owe them the 4,000 dollars. Is there a legal amount of timeframe. . Like I have stated on dis-ability money is short. I feel like there has to be a law in affect in canada that protects the consumer.. living on a cpp disabilty is not a gravytrain.it really is shocking after reporting my income to the carrier and now being harassed 4 years later.

Can you tell me if I'm right? You collected payments from both for a period?
Not having the money to pay them back is not a legal defense. I don't believe the Statute applies because this is not a debt, it's an overpayment. Have you been charged with fraud?

I collected the extended sic benefit till the cpp disabilty was approved from the government. I notified immediately the sic benefit insurance carrier. They stopped payments. Now 4 1/2 years later I received a phone call stating I have to re-pay the 4000 dollars back from them. My question is basiclly am I bound from canadian law to re-pay. 41/2 years of no contact from these folks and suddenly demanding payment sounds threatening.. I know there's a limitations act in ontario canada but I don't fullyunderstand it. That's why I have been asking.

Canadian Law applies to debts - this is not a debt. This is an overpayment which, apparently, you received and kept.
