    If not small claims then how do I get my dog back without going and taking him
    She was lying and being devious and gave my dog away to someone else I found by tracing him through a vet near her house she refuses to give me my dog so I have them all in court in 2 days

    I believe you indicated in your other thread that the police and the judge have been involved and are aware of the situation. If the police refuse to get involved without a court order, apply to the judge who issued the restraining order for another order directing the police to go get the dog for you.

    You might also notify the people who have the dog (if you can do so without violating the restraining order) that the dog is yours and that you want it returned.

    Thank you for responding yep the sister in law gave him to a friend of hers I traced him through the vets I already went over there with the police asking if they were willing to give me my dog back they said no so I said I will see you in court however the dog was 600 dollars and I have all the proof needed to prove he's mine and the court is in 2 days she is saying the sister gave him to her and I'm saying I never GAVE my dog to anyone it was suppose to be only for 2 weeks so is small claims judge able to rule the dog be returned to me?thank you for taking time out for my question

    I don't know the specific rules for where-ever you are, but (as I said) normally not. However the judge may be able to unofficially make it happen. That's why I think that applying for this relief in the restraining order case may be more productive.
