    got served
    I was served papers to respond within 20 days or court will proceed without me. I did with a paralegal who responed to the court and the banks lawyer. Question is , can they still come to the house and take things for fair market value ? My wife couldn't pay the van no more and they auctioned it off. Balance is 15 K plus 9.5 interest for 8 months. I want payments but the bank wouldn't do it. Hoping the court makes bank arrange it.

    Is the bank's claim in Small Claims Court or in a higher court? Also which state or province was the claim filed in?

    The bank sueing me is from CA, and it is a District Court in las vegas ,NV.

    15K is generally beyond the limits of small claims court. The limit for Nevada is $5K.

    They can't take anything until they obtain a judgement against you. And they are unlikely to take personal property.
