I was at a eating establishment (Chapps Cafe) in Fort Worth, Texas off Hulen Blvd. and bit into a burger and broke my tooth also. But I do still have the evidence, it was a bone or some type of rock like substance. I've been getting the run around and also they've been trying to get me to let them have the evidence before they fix my tooth. I'm going to contact an attorney, screw letting them get away with it. I also called the health department and the local news station, it's been four days, and my tooth still hurts!!

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Having the evidence does you no good unless a chain of evidence is in place. Where you alone, do you have someone to verify that the piece of whatever came from the burger?

Do you have dental coverage? What happened when you reported it to the restaurant at the time? Who have you been talking to?

Whatever happens do NOT hand them the evidence; did you immediately file an accident report with the restaurant? Was anyone else made aware that this happened (witnesses)? If you are in pain you can always get the tooth repaired, just make sure the Dentist has very detailed notes, including (if he/she will) the cause of the problem. For example, teeth don't just fracture by themselves. You can then approach the restaurant, bill in hand, and request payment. Minimally write the restaurant a letter and demand that the matter be turned over to their insurance company. (Be calm, collected, don't be angry, don't be accusatory - you were eating such and such at such a such a time and this is what happened - )

As far as contacting the media - I would be surprised if anyone is interested (unfortunately).

I recently had a tooth break while eating at Sonic. However, when I went to the dentist, I learned that my tooth had decay and my wisdom tooth was coming through smashing this tooth between it and the one in front. The tooth had never given me any trouble. So, it might not have been the restaurant's fault. Even though you bit into something, I'm thinking it'd have to be awful big and your bite would have had to been pretty strong to break your tooth if nothing is wrong with your tooth. I'd think to have any case, you'd have to have documentation from the dentist proving that you had nothing wrong with you to make this tooth susceptible to breaking/chipping/cracking, whatever.
