    Bad experience with Local shop owner
    Placed an order for food item on Saturday to pick up the same on Monday at 2 o clock for which I paid in full money on Saturday itself so that order will be confirmed and it will be ready to pick up. When I arrived there on Monday to pick up the order first thing the order was not ready.2nd thing they could not trace my order and then they tried to contact the person whom I placed an order. But they could not trace him also. In spite of showing them the receipt of the order sukhadia was not ready to trust me. Finally after wasting 1 hr there they asked me to pay again and come over the week end to get my refund. When I went there over the week end to get my refund nobody was ready to talk to me I spent almost ½ hr there. Finally when I talked to owner I told the owner the whole story BUT in return the owner asked me what proof you have I showed them the receipt and they told me these type of receipt I can not accept and refused to give me the refund.

    This is totally disgusting it was a matter of less than $30 which is very small amount. We give business to these shops but these people don’t trust there customers. If it was an American shop they would have given the item free of cost and also they would have apologizes. But here the case is opposite neither they are ready to accept there mistake and nor ready to give credit of double charges.

    It’s not a matter of double charges it’s a matter of trust. Just think over this when lot of other customers is standing besides you and if the owner of the restaurant is asking what is the proof you have.These type of receipts are common receipt how you will feel. Its like I am lying and trying to get the credit for small amount.

    Finally I called the credit card company and asked told them to dispute the charges as the shop owner is not ready to give me the credit.

    I was totally mentally disturbed because of this issue. Can I file a suit against for mental agony.

    You advice is highly apprecited.

    You called your credit card company and told them to dispute the charges. Good. Yes, you can sue them in a small claims court if you do not get your refund. Mental anguish? Not likely. Just the amounts of money you gave and were not refunded.

    I would caution against litigation due to the amount of money involved. The court may not be amused over a $30 lawsuit. I forget how it is worded in latin but there is a legal principle where the court should not be troubled over minor matters.

    It has been called a "trivial law suit." Is the suit worth it all? I can understand the frustration and anger. It is very poor customer service. If there is local commerce department to complain to, do that. If you do not get your money refunded, it sure would not be one place I would never go back to and tell my friends why.

    I don't know where you live but in the US you CANNOT collect for "mental agony" on a contract matter and this IS a contract matter - you agreed to give them X dollars and in exchange they agreed to give you food and they defaulted on the contract.

    You have already disputed the charge and that's about all you can do.

    Your comment about had this been an American shop... shows you know little about American shops. First, unless the shop is outside of the US (it doesn't sound like that), then it IS an American shop. Second, it sounds like the shop is run by immigrants, but that doesn't give them any edge or "american" shops in poor customer service. In fact, an immigrant shop is more likely to provide better customer service.

    Now, I don't understand what this receipt was. You state you put the order on a credit card, did you show them that? Did you explain that's how you paid and ask them to check their billings?

    One of the advantages of paying by credit card is dispute resolution. Instead of making a fight of this, I would have just told them you would be cancelling the charge and leave.

    As for a suit, the cost of filing would be about the same amount you could recover.
