Do I have the rights to evict
I own the house I'm living in and want to evict my ex-girlfriend. We built the house together. We were on the deed together. However she got herself in trouble at her work 5 years ago stealing money. She then signed the house over to me. She went to jail. I took her back under the pretense she would not drink. She has broken that promise over and over again. I no longer want her here can I evict her out? I gave her a notice of quit yesterday, for 30 days. I'm then will do a summons on the 31 st day is this correct? I have been paying the mortgage the past 5 years and the taxes. She did help with utilities, but a lot of times she would overdraft her account and I would then help her get it right. I know longer want her in my life.

If you live in a state that recognizes "common law" marriage (you co-habitated for a certain amount of time), you will have to treat it as such, going through all the same divorce requirements as if you were legally married... assets are divided, etc. Many states have this type of law on the books. Check with a divorce expert in your area.

I don't think she's a tenant so you can't evict her. She's a part owner, and you're going to have to do something for her besides just throwing her to the curb.

How did she sign it over to you, quit claim deed ? Are you the sole owner at this time.
But she may have some claim, so you need an attorney
|

If you are now the sole owner, then you can evict her. She might be considered a trespasser, but I would go the same route and treat her has a roomamate and go through formal eviction.
