    Durham describes in testimony James Comey's deception
    Sad spectacle at the Durham testimony in the House yesterday was the about to be sanctioned liar Adam Schiffhead's grilling of Russia Hoax investigator John Durham .


    That farce detracted from the important accounting that Durham made about a relevant sequence of events .

    Durham responding to questions from Rep Jim Jordan said that then CIA Director John Brennan had on July 28 ,2016 warned the emperor ,Quid Pro Joe ,Att General Loretta Lynch ,and DNI James Clapper , that the Evita campaign planned to set up the Russia Hoax as a dirty trick to detract attention from the FBI investigation of her emails .

    This was a plan concocted by Evita operative Jake Sullivan who is now the National Security advisor for Quid.

    That information was passed on to the FBI Director James Comey and his flunky Peter Strzok (who's texts to his paramour Lisa Page reveal that the FBI had an "insurance policy" to prevent Trump from becoming President) in a referral of information called a 'Counterintelligence Operational Lead '(CIOL).

    The CIOL states ;
    "Per FBI verbal request, CIA provides the below examples of information the CROSSFIRE HURRICANE fusion cell has gleaned to date," the memo continued. "An exchange [REDACTED] discussing US presidential candidate Hillary Clinton’s approval of a plan concerning US presidential candidate Donald Trump and Russian hackers hampering US elections as a means of distracting the public from her use of a private email server."

    That information was NOT passed on by Comey to his agents when 'Crossfire Hurricane ' was opened on July 31,2016 .

    According to the Durham report;
    "The aforementioned facts reflect a rather startling and inexplicable failure to adequately consider and incorporate the Clinton Plan intelligence into the FBI’s investigative decision-making in the Crossfire Hurricane investigation"

    "Indeed, had the FBI opened the Crossfire Hurricane investigation as an assessment and, in turn, gathered and analyzed data in concert with the information from the Clinton Plan intelligence, it is likely that the information received would have been examined, at a minimum, with a more critical eye"

    The report goes on ;

    "Whether or not the Clinton plan intelligence was based on reliable or unreliable information, or was ultimately true or false it, it should have prompted FBI personnel to immediately undertake an analysis of the information and to act with far greater care and caution when receiving, analyzing, and relying upon materials of partisan origins, such as the Steele Reports, and the Alfa Bank allegations"

    That is of course IF the investigators were privy to the information .

    The FBI investigators acted on the information they had received from the top brass .

    Durham told Rep Jordan that they were shocked and upset when HE TOLD THEM about the CIOL .

    JORDAN: “Can you tell the committee what happened when you took that referral memo, and shared it with one of those agents?” DURHAM: “He indicated he had never seen it before. He immediately became emotional…” JORDAN: “He was ticked off!” DURHAM: “The information was kept from them”

    The director of the FBI knowingly withheld evidence pertinent to an FBI investigation. That resulted not just in errors made by the agents conducting the investigation that might have resulted ending what turned out to be a witch hunt that lasted well into the Trump Presidency and cost the nation $millions in a wasted investigation . Most important ;it also contributed to misrepresentations to the FISA court about the nature of the evidence they used to conduct surveillance on Trump campaign figures.

    Next on the hit list will also come from NY Alvin Bragg contents that Trump's paying hush money to Stormy Daniels was a campaign violation . Not because it violated campaign finance laws ;but because it was an attempt by Trump to hide facts that the voters had a right to know.
    In one instance, American Media Inc. (“AMI”), paid $30,000 to a former Trump Tower doorman, who claimed to have a story about a child TRUMP had out of wedlock.
    In a second instance, AMI paid $150,000 to a woman who alleged she had a sexual relationship with TRUMP. When TRUMP explicitly directed a lawyer who then worked for the Trump Organization as TRUMP’s Special Counsel (“Special Counsel”) to reimburse AMI in cash, the Special Counsel indicated to TRUMP that the payment should be made via a shell company and not by cash. AMI ultimately declined to accept reimbursement after consulting their counsel. AMI, which later admitted its conduct was unlawful in an agreement with federal prosecutors, made false entries in its business records concerning the true purpose of the $150,000 payment.
    In a third instance – 12 days before the presidential general election – the Special Counsel wired $130,000 to an attorney for an adult film actress. The Special Counsel, who has since pleaded guilty and served time in prison for making the illegal campaign contribution, made the payment through a shell corporation funded through a bank in Manhattan.

    If anything these acts were violations of FEDERAL campaign finance laws . But the Feds declined to make a case against Trump on these accusations.

    He can't make a case that paying off Daniels was illegal because it wasn't . He can only claim it was a campaign finance violation that the Manhattan DA has no jurisdiction over.

    His claim that Trump's attempt to conceal the payments represents a felony in NY law doesn't hold water . It could only be a felony if Trump was trying to conceal a crime .
    Putting morality aside 'Trump schtupping a porn star was his and her business.

    Bragg claims Trump violated election laws but refuses to state publicly which ones. Former DA Cyrus Vance Jr considered the case and rejected it, Bragg I am sure is taking marching orders from the Federal Justice Dept.

    They are hitting Trump first at the local level because his claims of immunity don't hold . Then as a bull taking scores of wounds from picadors ;a weakened Trump will be slayed by the "brave" Federal matador .

    That is true only if the rule of law is still in effect. I'm not too sure that's still the case.

    NYC is already considered to be a hostile environment to run a business . Imagine what a fine of what Letitia James estimates will be over $460 million after interest AND a suspension from doing business for 3 years will be perceived by the business class.

    NY Guv Kathy Hochul went on a local NYC radio station to assure other business people of the city that they have nothing to fear .

    That's because they all have almost a $ half billion to surrender to their thieves that run the city .

    Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.


    There are also 14th Amendment due process issues abounding .

    Assuming this case goes eventually to SCOTUS ;and they don't give excessive deference to local law ;this should be an easy appeal.

    For James this was predictable. She has been a one sided partisan hack . She is trying to disband the NRA

    This whole thing reminds that sometime reality is stranger than fiction.
    Years ago I read Tom Wolfe's novel /commentary on NYC 'Bonfire of the Vanities ' . When I write about the 'masters of the universe' it is a direct reference to the book . The masters were Wall Street workers but it can just as easily apply to a real estate mogul.
    One of the " masters" made a wrong turn in the Bronx and in his panic did a hit and run which put him afoul with the legal and political establishment of the city The book describes his ultimate fall from grace and the heights of success ...to the delight of New Yorkers .

    Eric Trump commented Friday on the ruling:

    “My father built a skyline of New York City. And this is the thanks he gets for doing absolutely nothing wrong, not a dollar of financial loss? The exact opposite, hundreds of millions of dollars in financial gain,”

    Every single witness testified we have nothing to do with this. They went in, witness after witness, this is not what they did in the company. It didn’t matter to this guy. You know, we were trophies on a wall for this guy,” he added. “This is the state of New York.”
    The appeals will test the claims that NY has impartial nonpartisan justice system that does not persecute political opponents .

    The appeals process will, I suppose, last for years. I would think Trump's chances for a favorable outcome are at least 50/50.

    Trump complains that he is the victim of a partisan vendetta. The NY cases have one thing in common. Neither Bragg of James were able to actually produce a victim ;which lends credibility to his complaint . But both cases have set the stage for Trump's downfall.

    In particular Trump needs to get a stay on the James verdict . He does not have a $ half billion sitting in his pockets which he was required to post the day the verdict was rendered (interest due began immediately ) . Even if he did ;how would he be able to pay for his legal expenses for an appeal and for all the other charges against him in the Bragg prosecution; the DC case ;and the Fed cases against him?

    That was the case the deep state needed to prep the battle .

    It is nothing less than the weaponization of the legal system. The case involving supposed fraud is obviously foolish to anyone who looks at it fairly. How many other cases have they brought involving "fraud" in that respect? The answer is zero, and it is plain that they brought this case in order to get Trump. They might want to be careful. Electing a living martyr is sometimes an easy process.

    There is one other that has come to my attention.

    Tesla was the darling of the deep state until Musk entered the political arena and upset the deep state.

    So they sic'd the dogs of lawfare on him. He has been subject to regulatory harassment for both Tesla and SpaceX . But that is small potatoes .Lawfare's goal is ultimately a coup de gras.

    Tesla had an incentive based compensation package for employees .It was approved by 80% of the share holders. The plan "contained performance milestones so lofty that they were ridiculed by some Wall Street investors, and blessed by a shareholder vote that was not even required under Delaware law. " Itwas ambitious in it's goals ;and in the end rewarded Musk for meeting those goals to the tune of $56 billion

    One shareholder ;Richard Tornetta, who had 9 shares.... $200 worth of shares in 2018(valued at $2,000 today) was not happy. So he took it to Delaware's "justice system" . Delaware being the home field of Clueless Joe.

    Chancellor Kathaleen McCormick[of the Court of Chancery ordered the dismantling of 5 years of Musk’s bonus compensation.

    She decided that the share holders were not adequately informed when they approved the package ;and that the compensation was not in the best interest of Tesla because Musk was " a controlling shareholder with a potential conflict of interest, the pay package must be subject to a more rigorous standard."

    She has not said yet how this plunder of Musk's wealth should be divvied up . But Tornetta ;with his 9 shares that are 1000% more valuable than in 2018 thinks he should get a slice of the pie as a fee for bringing the case to court .

    NY (many banks located there) and Delaware ( many businesses incorporate there )are in unique positions to play $$$$ politics ;more so than any other state in the union ;save perhaps California

    Short of appellate court reversals in the Trump and Musk cases ;the world knows that the US is no longer the default place to do business; as equal justice under the law has become questionable .

    So how bad was the Trump and Musk decisions in NYC and Delaware ? Even Jeb Bush ;who doesn't mask his hatred of Trump ; called the decision crazy and unfair.

The appellate courts in those states now have a chance to review these dangerous judicial rulings and try to stop further damage to the reputations of their respective judiciaries.
    If they don’t, blue-state politicians may have the satisfaction of “sticking it” to Messrs. Trump and Musk, but the loss to those states will be significant. The damage to the legal fabric of the country will be even worse. A dispassionate justice system is at the heart of American exceptionalism, and the country will be poorer if we lose it.

    Well that ship has already sailed .

    Every single real estate developer everywhere on earth does this. They always talk about their asset being worth a lot and the bank says no. That’s just the way it is.

    Musk is moving his incorporation of SpaceX out of Delaware to Texas and is doing the same with Tesla . He is also moving Neuralink from Delaware to Nevada .

    He is calling on all Delaware incorporated businesses to do the same. Recently Tripadvisor pulled up stakes . They plan to move to Nevada after a Delaware judge gave a stamp of approval.

    And yet people stand idly by or even applaud these decisions because of an "I hate Trump" mentality. That's the only justification for all of this. I continue to wonder what Trump must know that makes them so fearful of him having another four years. It can't be a fear of having an incompetent president. If that was the case, four more years of Biden would be an even more terrifying thought.
